Power of Attorney is a legal instrument that assigns legal authority to another. The person who signs a Power of Attorney is called the Principal. A person who granted a legal authority is called Attorney- in- Fact. Power of Attorney is used in the event of principal illness, disability, or when the Principal cannot be present to sign legal documents. There are “Durable“, “Non-durable” and “Springing” Power of Attorney. A “Non-durable” Power of Attorney takes effect immediately and remains in effect until revocation by the Principal, or until the Principal becomes mentally incompetent or dies. “Durable “ Power of Attorney takes effect immediately and is effective until it is revoked by the Principal or the Principal dies. Its remains in effect even after the Principal is not mentally competent or physically able to make decisions. A “Springing” Power of Attorney takes effect in future time upon the occurrence of a specific event, specified in the Power of Attorney, like illness or disability of the principal and remains in effect until the Principal’s death, or until its revoked by the Court.
