If the parents of a child were not married to each other when the mother become pregnant or when the child was born, a biological father is not considered as a legal parent of a child. To establish paternity petition for the order of filiation has to be made in the court. Before the order of filiation is established a father has no legal obligation to pay support for the child, and has no right to custody or visitation with the child. The petition may be filed by the child's mother, by the biological father, by child, or child's guardian. After the petition is made and father admits that he is the father order of filiation is established. If the respondent denies that he is the father than petitioner has to bring sufficient proof and court will enter the order of filiation. If petitioner failed to present proof then petition will be denied.
